Privacy Policy

Discover our privacy policy to understand our commitments and our transparency towards our users.

Introduction

When you use the Wakastellar solution's website(s) (and its products: Wakasign, Wakastart, Wakabooster — hereinafter, "the Site(s)"), you entrust us with certain personal data. We attach great importance to protecting and securing our Users' data, and we have drafted this Personal Data Protection Charter (hereinafter, "the Charter") to inform you of our privacy practices.

This Charter has been designed to provide you with the information needed to understand what Personal Data we collect, why we collect it, and how you can update, export or delete it.

The Charter applies to users browsing the Site, and forms an integral part of the Terms and Conditions of Use.

Definitions

The definitions contained in this Site's Terms and Conditions of Use also apply to this Personal Data Protection Charter.

Personal data: Refers to any information relating to an identified or identifiable natural person (hereinafter referred to as a "data subject"). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity.

Sensitive data: Sensitive data is a special category of Personal data. This is information revealing alleged racial or ethnic origin, political opinions, religious or philosophical beliefs or trade union membership, as well as the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health, or data concerning a natural person's sex life or sexual orientation.

Data controller: Refers to the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing; where the purposes and means of such processing are determined by Union or Member State law, the controller may be designated, or the specific criteria for its designation may be provided for, by Union or Member State law.

Site: Refers to the website(s) published by the Wakastellar Group and owned by it.

Data processing: Refers to any operation or set of operations performed, whether or not by automated means, on personal data or sets of personal data, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

User: Refers to any person visiting the Site(s) made available by Wakastellar.

Who is responsible for processing your data?

The Wakastellar Group, a simplified joint-stock company (SAS) with share capital of €10,000, registered with the Nantes Trade and Companies Register under number 107 956 120, whose registered office is at 115 le clos papin, 44310 SAINT PHILBERT DE GRAND LIEU, France, is the Data Controller for the Personal Data collected in connection with use of the Site within the European Economic Area and the United Kingdom.

In this respect, please note that none of your personal data is transferred outside the European Union. Generally speaking, your Personal Data is never disclosed to persons outside the Wakastellar Group's organisation.

What data is collected, and when is it collected?

In the course of your browsing of the Site, the Wakastellar Group may collect the following Personal Data:

Information relating to the identity of the Site User

When you send a message via the contact form available on the Site, the information collected includes your surname, first name, the name of the company you work for, your email address, your phone number, and any information contained in the message accompanying your request.

We therefore collect Personal Data:

  • When you or your organisation request information about our services via the contact form on the Site.
  • When you correspond with us in any way whatsoever.

In this context, we only process the Personal Data you provide to us directly.

Why is your personal data collected and processed by the Wakastellar Group?

We collect and use data to:

1. Manage user requests

We use the information collected to provide customer support, including to:

  • Send responses to Users' questions and requests for information;
  • Investigate and resolve issues Users may encounter on the Site;
  • Monitor and improve the quality and processes of our customer support.

2. Carry out marketing activities

The Wakastellar Group may use the data collected to promote its services to Users, for example, to send them communications regarding the group's solutions, events, surveys and news.

3. Communicate about our developments

The Wakastellar Group may use the data collected to inform Users of changes made to the Terms and Conditions of Use and/or the Charter.

The Wakastellar Group does not sell or share Users' Personal Data with third parties for direct marketing purposes, except with the Users' express consent.

How do we justify processing this data?

The legal basis for data processing is the User's consent to the collection of data when they complete the contact form.

Who do we disclose your data to?

Your data is strictly confidential and is not disclosed to any third party.

On the basis of legal obligations, your Personal Data may be disclosed pursuant to a law, a regulation, or a decision by a competent regulatory or judicial authority.

Processing responsibility

The Wakastellar Group undertakes to comply with the regulations in force applicable to the Processing of personal data, and in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, applicable from 25 May 2018 (hereinafter, "the Regulation").

It is for Users to check whether the Regulation applies to them and to take the necessary steps to comply with applicable legislation.

The Wakastellar Group processes Personal Data, within the meaning of Article 24 of the Regulation, as data controller.

How long does the Wakastellar Group keep your data?

Data collected will be retained by the Wakastellar Group for a period of one year from the date a request is sent via the Site's contact form.

Data purging mechanisms are in place to ensure effective deletion once the retention or archiving period necessary to achieve the specified or required purposes has been reached.

In accordance with Act No. 78-17 of 6 January 1978 on information technology, data files and civil liberties, you also have the right to request deletion of your data at any time by contacting us at contact@wakastellar.com.

What are your rights?

You may have the following rights under applicable law, and may exercise these rights in accordance with the instructions in point 10 of the Charter:

Right of access (Art. 15 GDPR)

You have the right to request confirmation of whether your Personal Data is being processed and, where applicable, to request access to the Personal Data we hold about you.

Right to rectification (Art. 16 GDPR)

You have the right to request the correction of any inaccurate Personal Data.

Right to erasure (Art. 17 GDPR)

You have the right to request the erasure of Personal Data in certain circumstances, in particular if you consider that your Personal Data is no longer necessary for the purposes for which it was collected, or if you withdraw the consent on which our processing is based and there is no other legal ground for the processing.

Right to restriction of processing (Art. 18 GDPR)

You have the right to ask us to restrict the processing of your Personal Data in certain circumstances, in particular if you believe the Data we process is inaccurate.

Right to data portability (Art. 20 GDPR)

In certain circumstances, you have the right to receive the Personal Data you have provided to us, on simple request, in a structured, commonly used and machine-readable format, and you have the right to transmit that data to another controller without hindrance, or to ask us to do so on your behalf.

Right to object (Art. 21 GDPR)

You have the right to object to the processing of your Personal Data in certain circumstances, in particular if we process it on the basis of our legitimate interests, or if we use it for marketing purposes.

Unsubscribing from communications and our privacy commitment

When you fill in a form on this site (contact request, free audit request, quote request), the Wakastellar Group needs the contact details you provide to reach you about our products and services. This contact information is never sold, rented or transferred to third parties for commercial purposes.

How to unsubscribe

You can unsubscribe from our communications at any time, with no justification and free of charge:

  • by clicking the unsubscribe link at the bottom of each of our emails;
  • by writing to us at contact@wakastellar.com with the subject line "Unsubscribe";
  • by simply replying "STOP" to any of our emails.

Your request will be processed within a maximum of 72 business hours. Unsubscribing ends commercial communications, but does not interrupt exchanges strictly related to a request you initiated or an ongoing contract.

Our commitment to data protection and privacy

Protecting your data is part of what we do. Our internal practices are based on the requirements of the ISO 27001 standard and GDPR principles: minimising the data collected (we only ask for what is necessary to process your request), hosting data on sovereign infrastructure located in France, encrypting data in transit and at rest, restricting access to only those staff who need it, and deleting or anonymising data at the end of the retention period specified in this policy.

We do not carry out any advertising profiling, any resale of files, or any automated decision-making producing legal effects on you. Any questions relating to these commitments may be sent to contact@wakastellar.com.

What cookies does/do the site(s) use, and how can you opt out of their use?

Session cookies are essential for browsing our Platform and providing the services you request from us. This cookie disappears once the browser is closed, and therefore cannot be deactivated.

Your web browser may offer you options for managing cookies. Please note that if you delete or choose not to accept cookies, you may not be able to make full use of the features of the services offered via the Site.

In accordance with legal requirements, your consent to the collection of cookies is valid for 13 months.

We use cookies and automatically collected information to:

  • Personalise our Site and the services provided through it, for example by remembering your data so you don't have to re-enter it when you use, or next use, our Platform and the services provided through it;
  • Monitor Site traffic statistics, such as the total number of visitors and pages viewed.

Please note that restricting cookies may affect your user experience and prevent you from using certain parts of our Platforms or services.

To exercise your rights, please send your request as indicated below, specifying the following information: surname, first name, email address and any other information needed to confirm your identity so that we can process your request (e.g. your postal address).
